Terms of Use
Last updated 22 August 2026
These terms govern your use of this website. They are not the terms on which a mediation is conducted. If a mediation goes ahead, a separate agreement is signed by everyone taking part, and that agreement governs the mediation itself.
About these terms
Settle Smart Mediations is a registered business name of Kayla Christie Curtis, ABN 72 368 827 692, who trades as a sole trader. In both documents "Settle Smart Mediations" means that business, and "you" means the person using this website. Because the business is a sole trader, the obligations set out here are Kayla Curtis's own.
Using this website means you accept these terms. If you do not accept them, do not use the site.
What this website is
This website describes a mediation practice and what it does. The information on it is general, is published in good faith, and is current at the date shown above. It is not tailored to your situation, because no one has heard your situation yet.
Nothing on this website is an offer capable of being accepted, and nothing on it creates a booking.
Nothing here is legal advice
Settle Smart Mediations provides mediation only. Nothing on this website is legal advice, and reading it does not make anyone your lawyer.
Kayla Curtis has legal qualifications, which are set out on this site as background. They are not a service offered here. Settle Smart Mediations does not act for either party, does not give either party legal advice, and does not tell anyone what a court would decide.
If you need advice about your rights, get it from your own lawyer. That advice is often worth getting before a mediation, and worth getting again before signing anything that comes out of one.
Sending an enquiry
Sending an enquiry does not engage Settle Smart Mediations, does not reserve a date, and does not create any obligation on either side. An engagement begins only when it is confirmed in writing and the mediation agreement is signed.
An enquiry is an ordinary email. It is not confidential in the way a mediation is, and it is not covered by legal professional privilege. Send enough for a first response and no more.
Enquiries are answered as soon as reasonably possible, but no response time is promised on this page. If a matter is urgent, call rather than write.
Mediation is governed by a separate agreement
If a mediation goes ahead, all parties and the mediator sign a mediation agreement first. That agreement covers confidentiality, the conduct of the session, what happens to documents, and the limits of the mediator's role. Where these terms and that agreement differ on anything to do with the mediation, the mediation agreement prevails.
The nature of mediation
Two things follow from mediation being what it is, and both are limits rather than fine print:
- Mediation is voluntary. Every party has to agree to take part, and any party can stop. If the other party declines, there is no session.
- No outcome is guaranteed. The mediator facilitates an agreement and does not impose one. Whether a dispute settles, in whole or in part, is decided by the parties and by nobody else.
Settle Smart Mediations does not decide who is right, does not make decisions for the parties, and does not promise that any particular result will be reached.
Section 60I certificates
Settle Smart Mediations does not issue section 60I certificates. If you need one, you will need to engage a practitioner who holds the accreditation required to issue them. Say so when you enquire and you will be told straight away whether this service fits what you need.
Fees
The fees shown on this website are current at the date above and include GST, so nothing is added to the figures shown. Those figures are indicative until confirmed. The fee that applies to your matter is the one confirmed in writing before the mediation is booked, and it does not change afterwards.
Cancellation, rescheduling and refund terms are set out in the mediation agreement and are explained before you are asked to pay anything.
Intellectual property
The text, layout, logo and other material on this website belong to Settle Smart Mediations or are used with permission. You may read it, print it and share a link to it. You may not republish it as your own, or use the Settle Smart Mediations name or logo, without written permission.
Availability of this website
This website is provided as it is. It may be unavailable at times, and it may be changed or taken down without notice. No promise is made that it will always be reachable or always up to date. Do not rely on the enquiry form for anything time critical. The phone number is on every page for that reason.
Other websites
This site may link to other websites for convenience. Those sites are not controlled by Settle Smart Mediations, and linking to one is not an endorsement of it or of anything on it.
Liability
Certain rights and guarantees under the Australian Consumer Law cannot be excluded, restricted or modified. Nothing in these terms attempts to do so, and everything below is read subject to that.
Subject to that, Settle Smart Mediations is not liable for any loss arising out of your use of this website, or from relying on general information published on it, to the extent the law permits that position.
Where liability for a failure to comply with a consumer guarantee can lawfully be limited, it is limited to supplying the services again or paying the cost of having them supplied again.
Privacy
Personal information collected through this website is handled in accordance with the Privacy Policy, which forms part of these terms.
Governing law
These terms are governed by the laws of NSW, Australia, and the courts of that place have jurisdiction.
Changes to these terms
These terms may be changed at any time. The version that applies is the one published here when you use the site, and the date at the top shows when it last changed.
